Although recreational marijuana (Cannabis) will be legalized, it does not mean that employees will go unchecked. Similar to alcohol and smoking policies in the workplace, policies can be put in place reflecting zero tolerance for impaired employees or customers or marijuana in the workplace or marijuana paraphernalia. However, a pure zero-tolerance policy may be problematic if an employer’s duty to accommodate is triggered.
